Hazardous Waste Regulations 2005
Eco-Oil operates in compliance with the important Hazardous Waste (England and Wales) Regulations (2005) and the Hazardous Waste Directive (HWD).
The HWD provides a precise and consistent definition of ‘hazardous waste’ for application across the EU.
Hazardous waste is defined as ‘waste featuring on the European Waste Catalogue (EWC)’ or waste that possesses one or more of the hazardous properties (H numbers) set out in the HWD, such as explosive, toxic and flammable.
The Hazardous Waste Regulations help to implement the Hazardous Waste Directive. They impact directly upon waste producers in England, Wales and Northern Ireland.
The term 'hazardous waste' includes waste previously classified as ‘special waste’. Hazardous waste should be separated from non-hazardous waste, wherever technically and economically possible.
Scotland operates different hazardous waste controls via the Special Waste (Amendment) Regulations 2004.
Impact of the regulations
The Regulations place the onus of responsibility on the waste producer under ‘the polluter pays’ principle.
With few exceptions, any commercial or industrial operation within England, Wales or Northern Ireland where hazardous waste is generated must register as a waste producer with the Environment Agency.
